This privacy policy ("Policy") describes how Budescu Sorin George ("Budescu Sorin George", "we", "us" or "our") collects, protects and uses the personally identifiable information ("Personal Information") you ("User", "you" or "your") may provide through the Working Hours 4b mobile application, the www.workinghours4b.com website, and any of their related products or services (collectively, the "Application" or "Services"). It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.
Data controller
The data controller responsible for your Personal Information is Budescu Sorin George, an individual operating the Application from Italy. For any question, request, or complaint regarding this Policy or your Personal Information, you can reach us at info@workinghours4b.com. Given the size and nature of our Services, we have not appointed a Data Protection Officer, as this is not required of us under Article 37 of the General Data Protection Regulation ("GDPR").
Collection of personal information
We receive and store any information you knowingly provide to us when you create an account, subscribe to a paid plan, or fill in any online forms in the Application. When required, this information may include your email address, name, or other Personal Information, as well as the working hours, jobs, and schedule data you enter to use the Services. You can choose not to provide us with certain information, but then you may not be able to take advantage of some of the Application's features. Users who are uncertain about what information is mandatory are welcome to contact us.
Collection of non-personal information
When you open the Application, our servers and service providers automatically record information that your device sends. This data may include information such as your device's IP address and approximate location, device name and version, operating system type and version, language preferences, information you search for in the Application, access times and dates, crash and diagnostic data, and other usage statistics.
Legal basis for processing
Where the GDPR applies, we only process your Personal Information when we have a valid legal basis to do so. This includes: performance of a contract with you (for example, to provide the Application's core features and manage your subscription); your consent (for example, for optional marketing communications, which you may withdraw at any time); compliance with a legal obligation; and our legitimate interests, such as securing the Application, preventing fraud, and improving our Services, provided those interests are not overridden by your rights and freedoms.
Managing personal information
You are able to access, add to, update and delete certain Personal Information about you directly from within the Application. The information you can view, update, and delete may change as the Application or Services change. When you update information, however, we may maintain a copy of the unrevised information in our records for a limited period. Some information may remain in our private records after your deletion of such information from your account, for as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally. Once the applicable retention period expires, Personal Information is deleted or anonymized. The right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after the expiration of the retention period.
Use of collected information
Any of the information we collect from you may be used to personalize your experience; improve our Application; provide customer service and respond to queries and emails; process transactions and manage your subscription; and run and operate the Application and Services. Non-Personal Information collected is used only to identify potential cases of abuse and to establish statistical information regarding Application traffic and usage. This statistical information is not otherwise aggregated in a way that would identify any particular user of the system.
Data storage and service providers
Account authentication and the data you create in the Application (such as jobs, shifts and working hours) are stored using Google Firebase (Authentication and Cloud Firestore), which acts as our data processor. We also use third-party service providers to help us operate the Application, process payments, and understand how the Services are used. These service providers are only given the information they need to perform their designated functions and are contractually restricted from using or disclosing your Personal Information for their own marketing or other purposes. We remain responsible for your Personal Information when it is processed by our service providers.
International data transfers
Some of our service providers, including Google Firebase, may process and store information on servers located outside your country of residence, including in the United States. Where Personal Information of users in the European Economic Area, United Kingdom, or Switzerland is transferred outside of those regions, we rely on appropriate safeguards recognized under applicable law, such as the European Commission's Standard Contractual Clauses, to ensure your information continues to receive an adequate level of protection.
Billing and payments
Paid subscriptions are billed through the Apple App Store, Google Play, or other third-party payment processors, who assist us in processing your payment information securely. We do not receive or store your full payment card details; these are handled directly by the applicable store or payment processor in accordance with their own privacy policies, which may or may not contain privacy protections as protective as this Policy. We suggest that you review their respective privacy policies.
Privacy of children
The Application is not directed at children and we do not knowingly collect Personal Information from children under the age of 13 (or a higher age of digital consent where required by local law, such as under the GDPR). If you are under this age, please do not submit any Personal Information through the Application or Services. We encourage parents and legal guardians to monitor their children's use of the Application and to help enforce this Policy by instructing their children never to provide Personal Information through the Application without their permission. If you have reason to believe that a child has provided Personal Information to us without appropriate consent, please contact us so we can delete it.
Your privacy rights
If the GDPR applies to you, you have the right to: request access to your Personal Information; request correction of inaccurate Personal Information; request erasure of your Personal Information; object to or request restriction of our processing of your Personal Information; request portability of your Personal Information; and, where processing is based on consent, withdraw that consent at any time without affecting the lawfulness of processing before its withdrawal. You may exercise most of these rights directly from within the Application, or by contacting us at info@workinghours4b.com. You also have the right to lodge a complaint with your local data protection supervisory authority, or with the Italian Garante per la protezione dei dati personali.
California privacy rights
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), gives you the right to know what Personal Information we collect, use, disclose, and (if applicable) sell or share about you; the right to request deletion and correction of your Personal Information; and the right to opt out of the sale or sharing of your Personal Information and out of certain profiling. We do not sell your Personal Information for money. We honor Global Privacy Control ("GPC") signals as a valid opt-out request where applicable. We will not discriminate against you for exercising any of these rights. You may exercise these rights by contacting us at info@workinghours4b.com. We may need to verify your identity before completing certain requests.
Cookies and similar technologies
Our website may use cookies and similar technologies that are strictly necessary for the site to function, as well as, with your consent where required, analytics technologies to understand how visitors use the site. You can control cookies through your browser settings; disabling them may affect certain features of the website.
Remarketing and advertisement
We do not currently display third-party advertisements in the Application. Should this change in the future, we will only work with third-party companies that help us tailor advertising to users' interests, and any such companies may deliver ads that place cookies or otherwise track user behavior, subject to your consent where required by law. We do not share personally identifiable information about individual users with advertisers; only aggregated, non-identifying information may be used for this purpose.
Information security
We secure information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. We maintain reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorized access, use, modification, and disclosure of Personal Information in its control and custody. However, no data transmission over the Internet or wireless network can be guaranteed. Therefore, while we strive to protect your Personal Information, you acknowledge that (i) there are security and privacy limitations of the Internet which are beyond our control; (ii) the security, integrity, and privacy of any and all information and data exchanged between you and the Application cannot be guaranteed; and (iii) any such information and data may be viewed or tampered with in transit by a third-party, despite best efforts.
Data breach
In the event we become aware that the security of the Application has been compromised or users' Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement and data protection authorities as required by law. In the event of a data breach likely to result in a risk to your rights and freedoms, we will make reasonable efforts to notify affected individuals without undue delay, or if notice is otherwise required by law. When we do, we will post a notice in the Application and/or send you an email.
Legal disclosure
We will disclose any information we collect, use or receive if required or permitted by law, such as to comply with a subpoena, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
Changes and amendments
We reserve the right to modify this Policy relating to the Application or Services at any time, effective upon posting of an updated version of this Policy in the Application. When we do, we will revise the "last updated" date at the bottom of this page and, for material changes, provide additional notice where required by law. Continued use of the Application after any such changes shall constitute your consent to such changes.
Acceptance of this policy
You acknowledge that you have read this Policy and agree to all its terms and conditions. By using the Application or its Services you agree to be bound by this Policy. If you do not agree to abide by the terms of this Policy, you are not authorized to use or access the Application and its Services.
Data processing
Your data is processed to operate the Services described above. Data you create in the Application (jobs, shifts and working hours) is used to display, calculate and sync your own information across your devices, and is only accessible to you and to the service providers described in the "Data storage and service providers" section above, acting on our behalf.
